1. Acceptance of Terms
By accessing or using Offerlytics (the “Service”), operated by Offerlytics, Inc. (“Company”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, do not use the Service.
2. Valuation Model & Decision Support Disclaimer
Offerlytics is an automated econometric and machine-learning decision-support tool, not a certified real estate appraisal, structural inspection, or legal/tax opinion. All valuations, price gap calculations, estimated option-period credits, and neighborhood metrics are statistical estimates based on public records and econometric models. Users should independently verify all findings with licensed real estate agents, certified appraisers, structural engineers, and legal counsel prior to executing purchase contracts.
3. Permitted Use & Intellectual Property
Offerlytics grants you a personal, revocable, non-exclusive, non-transferable license to access property intelligence for personal or internal professional evaluation. You agree not to:
- Reverse engineer, decompile, or extract proprietary model coefficients, boosting weights, or feature schemas.
- Use automated bots, scrapers, or scripts to bulk harvest property reports or submarket feeds without written authorization.
- Redistribute, resell, or sublicense the intelligence feeds to third parties.
4. Third-Party Data & Sources
The Service incorporates data licensed or syndicated from public entities and third parties (including Realtor.com® Research datasets, TCAD, City of Austin GIS, and FEMA). We do not guarantee the completeness, timeliness, or absolute typographical accuracy of third-party public filings.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Offerlytics, Inc. and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from real estate investment decisions, contract offers, or reliance on automated intelligence generated by the Service.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action arising from these Terms shall be filed exclusively in state or federal courts located in Travis County, Austin, Texas.
7. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted to this page with an updated revision date. Your continued use of Offerlytics following any update constitutes acceptance of the modified Terms.
